Ruling of importing, selling, buying and eating chicken and other meat slaughtered in the lands of Kufr.

Shaykh Aboo Abdi Rahmaan Yahyaa bin 'Ali al-Hajoori

Question: What is the ruling of importing chicken meat from the lands of Kufr? The likes of those named 'French Chicken' or other than that which are imported from the lands of Kufr? What is the ruling of eating them? Selling them? and buying them? Is this trade permissible?

Answer: The conditions for the correctness of a slaughtering of animals, chickens, or their likes of what Allah has made permissible to eat from their meat are: that the slaughterer be a Muslim or from the people of the book, and that the name of Allah is mentioned on it before it was slaughtered in order for it to be according to the Islamic way, as Allaah said:

الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ وَطَعَامُ الَّذِينَ أُوتُواْ الْكِتَابَ حِلٌّ لَّكُمْ وَطَعَامُكُمْ حِلُّ لَّهُمْ
Made lawful to you this day are At­Tayyibât [all kinds of Halâl (lawful) foods, which Allâh has made lawful (meat of slaughtered eatable animals, etc., milk products, fats, vegetables and fruits, etc.). The food (slaughtered cattle, eatable animals, etc.) of the people of the Scripture (Jews and Christians) is lawful to you and yours is lawful to them. [Surah al-Maidah: 5]

And Allaah also said:
لاَ تَأْكُلُواْ مِمَّا لَمْ يُذْكَرِ اسْمُ اللّهِ عَلَيْهِ وَإِنَّهُ لَفِسْقٌ
Eat not (O believers) of that (meat) on which Allâh's Name has not been pronounced (at the time of the slaughtering of the animal), for sure it is Fisq (a sin and disobedience of Allâh). [Surah al-An'aam: 121]

And the hadeeth of Shadaad bin Aws (radiAllaahu 'anhu) in Saheeh Muslim, that the Prophet (sallalaahu 'alaihi wasallam) said: إِنَّ اللَّهَ كَتَبَ الْإِحْسَانَ عَلَى كُلِّ شَيْءٍ (Allaah has prescribed al-Ihsaan on everything) and also : وَإِذَا ذَبَحْتُمْ فَأَحْسِنُوا الذَّبْحَ (If you slaughter, slaughter with Ihsaan). These slaughtered meat imported from France and from other than them from the lands of Kufr, either chicken and other meat, from what I know is that they don't fulfill the Shuroot as-Sihhah (conditions of the correctness) for the slaughtered animal to be eaten. As it is shown by the adillah (evidences), it is waajib to avoid eating such meat that are imported by the lands of kufr, and avoid selling them and other such trades which are promoted among the muslims as the hadeeth states: إن الله إذا حرم شيئًا حرم ثمنه (Verily if Allaah forbids somethng, He forbids earning from it.) Allaah has instead given us wealth of animals in this country (yemen) and other countries from the imports from the lands of Muslims. And with this richness it is haraam to eat the slaughtered animals in question, and (it is haraam) to buy them as the Messenger of Allaah said: إنه لا يدخل الجنة لحم نبت من سحت (أي من حرام) النار أولى به. (Any flesh that grows from ill-gotten gains is more deserving of being touched by Hell-fire).

These slaughtered animals raise doubt and suspicion for its permissibility or forbidennes on the intellect, the Messenger (sallalaahu 'alaihi wasallam) said:
دع ما يريبك إلى ما لا يريبك (Leave the doubtful matters to that which you don't have doubt), and the hadeeth is saheeh which is narrated from Hasan bin 'Ali (radiAllaahu anhu), and the Messenger (sallalaahu 'alaihi wasallam) said: فمن اتقى الشبهات استبرأ لدينه وعرضه (Whoever avoids the doubtful matters, he has absolved himself (from wrongdoing) in his religion and in his honor.) Agreed upon on Nu'maan bin Basheer (radiAllaahu anhu). And all praise is due to Allaah.

يجب ترك البدع : It is obligated to abandon Bid'ah

Shaykh 'Abdul 'Azeez ibn Baaz (rahimahullaah) said:

وكل بدعة وكل ضلالة وكل منهج يخالف شرع الله يجب تركه ويجب أن يسيرالناس جميعا ً على المنهج الذي سار عليه رسول الله صلى الله عليه وسلم في حياته ، ثم سار عليه صحابته والخلفاء الراشدون من بعده ثم تابعهم الأئمة المهتدون والسلف الصالحون، تابعوهم على المنهج القويم، والصراط المستقيم.
هذا هو المنهج الذي يجب الأخذ به والتمسك به، والسير عليه . والدعوة إليه وكل ما يخالف ذلك مما أحدثه الناس يجب أن يترك وأن يرفض مع البيان والإيضاح حتى لا يهلك هالك إلا عن بينة

Every Bid'ah and every misguidance and every manhaj that opposes the Shar'ia of Allaah then it is waajib to abandon them. It is waajib to call all the all of the people to be upon the manhaj on which the Messenger (sallalaahu 'alaihi wasallam) was upon during his lifetime, and after that on which his companions and the Rightly Guided Caliphs after him and those who followed them, the Imaams of guidance, and the righteous Salaf were upon. The manhaj al qaweem on which those who followed them were upon, the Siraat al-Mustaqeem.

This is the manhaj that it is waajib to hold on to and cling on to, and traverse upon. And every one of those who opposes this of which the people has innovated then it is waajib to abandon and reject them, clarifying them with a clear clarification up until no ones is destroyed except with evidence.

علامات أهل البدع The Signs of the Ahlul Bid'ah


قال الإمام ابن عثيمين رحمه الله :
Shaykh Saleh al-Uthaimeen (rahimahullaah) said:


لأهل البدع علامات ، منها :

(1) أنهم يتصفون بغير الإسلام والسنة، بما يحدثونه من البدع ، القولية ، والفعلية ، والعقدية .

(2) أنهم يتعصبون لآرائهم ، فلا يرجعون إلى الحق وإن تبين لهم .

(3) أنهم يكرهون أئمة الإسلام والدين .

Ahlul Bid'ah (they) have signs:

1) They attribute themselves to other than Islaam and Sunnah, which they have innovated, from Bid'ah : al-Gawliyyah (statements), al-fi'liyyah (actions), al;'aqdiyyah (beliefs).

2) They have bigotry to their opinions, so they do not return back to the haqq if its clarified to them.

3) They have hatred for the Imaams of al-Islaam and Deen.

Tareeqah (way) of Ahlu Sunnah wal Jama'ah طريقة أهل السنة والجماعة

شيخ الإسلام أحْمَدُ بن تَيْمية ـ قَدسَ اللَّه روحه‏
Shaykhul Islaam Ahmad ibn Taymiyyah (rahimahullaah)

ثم من طريقة أهل السنة والجماعة‏:‏اتباع آثار رسول الله صلى الله عليه وسلم باطنًا وظاهرًا، واتباع سبيل السابقين الأولين من المهاجرين والأنصار، واتباع وصية رسول الله صلى الله عليه وسلم، حيث قال‏:‏ ‏(‏عليكم بسنتي وسنة الخلفاء الراشدين المهديين من بعدي، تمسكوا بها، وعضوا عليها بالنواجذ، وإياكم ومحدثات الأمور، فإن كل محدثة بدعة، وكل بدعة ضلالة‏)‏‏.

ويعلمون أن أصدق الكلام كلام الله، وخير الهدى هدى محمد صلى الله عليه وسلم، ويؤثرون كلام الله على كلام غيره من كلام أصناف الناس، ويقدمون هدى محمد صلى الله عليه وسلم على هدى كل أحد، وبهذا سموا‏:‏ أهل الكتاب والسنة‏.‏
وسموا أهل الجماعة؛ لأن الجماعة هى الاجتماع وضدها الفرقة، وإن كان لفظ الجماعة قد صار اسمًا لنفس القوم المجتمعين، والإجماع هو الأصل الثالث الذى يعتمد عليه فى العلم والدين‏.‏
وهم يزنون بهذه الأصول الثلاثة جميع ما عليه الناس من أقوال وأعمال باطنة أو ظاهرة مما له تعلق بالدين، والإجماع الذى ينضبط هو ما كان عليه السلف الصالح؛ إذ بعدهم كثر الاختلاف وانتشرت الأمة‏.

As for the tareeqah (way) of Ahlu Sunnah wal Jama'ah: it is to follow the athaar (narrations) of the Allaah's messenger (sallalaahu 'alaihi wasallam) in secret and in open, and to follow the sabeel (path) of the first of those from the Muhaajiroon and Ansaar, and to follow the wasiyyah (testament) of the messenger (sallalaahu 'alaihi wasallam):Upon you is to follow my sunnah and sunnah of the righly guided caliphs after me, cling on to it, and bit on to it with your molar teeth, and beware of newly invented matters, for every newly invented matter is an innovation, and every innovation is a misguidance.

And it is to know that the most truthful speech is the speech of Allaah, and to know that the best of guidance is the guidance of Muhammad (sallalaahu 'alaihi wasallaam), giving preference to the speech of Allaah above the speech of the people, and to precede the guidance of Muhammad (sallalaahu 'alaihi wasallam) above the guidance of all other people, and those who hold on to this are called: Ahlul Kitaab wa Sunnah (The people of the Book and Sunnah).

And they are also called Ahlul Jama'ah; as the Jama'ah is to unify and the opposite is to split in to groups, and the word 'Jama'ah' became a name to those who unify (upon haqq), and ijmaa' (consensus) is from the three fundamentals which the knowledge of the deen is built upon.

And they weigh from these three fundamentals, the statements and the hidden and open actions of the people which are connected to the deen. And the ijmaa' that they cling on to is what the salaf saalih were upon; as for those who came after them have so many ikhtilaaf (differences) which spread upon the ummah.

Explaining the fundamentals of faith شرح أصول الإيمان

All praise is due to Allah,we praise Him, seek His Help and forgiveness; we repent to Him and seek refuge in Allah from the evils of our own slaves and from our wicked deeds . Whomsoever has been guided by Allaah , non can misguided and whomsoever has been misguided by Allaah non can guide him. I bear witness that there is no true god worthy or being worshipped except Allaah alone, without a partner or associate. I further bare witness that Mohammed (Salla Allaah Aleihi Waslam1 ) is Allaah true slave and Messenger ; may Allaah bestow His peace and Blessings on Muhammed (Salla Allaah Aleihi Wasallam), upon his good and pure family , and upon his noble companions and those who follow their path.

It proceeds then: that the knowledge about Tawheed2 constitutes the most noble and necessitated knowledge, because it represents the knowledge about Allah , His right upon His bondsmen . This knowledge is the key for the way to Allaah , and it is the foundation for His legislation. That is why there is a consensus amongst all the messengers to invite people to Tawheed . Allaah تعالى3 says:

( و ما أرسلنا من قبلك من رسول إلا نوحى إليه أنه لا إله إلا أنا فأعبدون)

And we did not send any Messenger before you (O Mohammed) but We inspired him (saying(: Lailaha illa Ana {none has the right to be worshipped but I (Allah)},so worship Me (alone and no Qur’aan 21:25

Allaah bears witness on His Wahdaniyyah: being the only true God that deserves to be worshipped alone and who has no coequal in Himself as well as in His Names and Attributes .The angles and people of knowledge also testify for His Wahdaniyyah :

( شهد الله أنه لا إله إلا هو و الملائكة و أولو العلم قائما بالقسط لا إله إلا هو العزيز الحكيم) ( آل عمران ،18)

Allaah bears witness that La illah illa Huwah ( none has Wright to worshiped but He,) and the angles , and those having knowledge (also give this witness); ( He is always) maintaining His creation in Justice . La illah illa Huwa , the All-Mighty, the All-Wise.(Qura’an 3:18)

Given this acknowledgement of the rank of Taweed, it is therefore incumbent upon every Muslim to give proper consideration to this matter through learning, understanding, education, and conviction, in order for him to establish his Deen 5on a sound foundation, confidence and submission that would give him the good fortune of sharing it’s fruits and results.

Is it sufficient for the salafee to know haqq and batil and not refute ahlul ahwa?

Shaykh Rabee' ibn Hadee al-Madkhali (hafidhahullaah)

In these times, is it sufficient for the Salafee to just know haqq (truth) and baatil (falsehood)or is it waajib upon him to refute the Ahlul Ahwa (people of desires) and those who differ from his da’wah (call)?

It is on the Salafee to know the haqq and call to it and clarify it to the people. And to establish this obligation, it is for him to refute baatil, as the Noble Qur’aan clarifies the haqq and refute the baatil at the same time, such as good is mentioned with the mentioning of evil, the Mu’mineen (believers) are mentioned and the Munaafiqeen (hypocrites) are mentioned, the kuffar (disbelievers) are mentioned, the Yahood (Jews) are mentioned, the Nasaara (Christians) are mentioned with their evil. So Islaam is established on these pillars which explains it and establishes Jihaad and ‘amr bil mau’roof (commanding good) and nahee anil munkar (forbidding evil) and refuting falsehood. It would never be established except without this and Islaam would never be established ever except with the establishment of the haqq and exposing and clarifying and criticizing the baatil, and clarifying their ugliness, their evilness, and tahdheer (warn) about this (falsehood) with its people. Any da’wah which does not establish this obligation then it is nothing but a defeated da’wah; dead, carrying the germs of death itself. No da’wah is living except by raising the banner of the haqq and bringing down baatil at the same time.

And this is it what Allaah ta’aala has said:
( كنتم خير أمة أخرجت للناس تأمرون بالمعروف وتنهون عن المنكر )
{You are the best of peoples ever raised up for mankind; you command Al-Ma'roof (i.e. Islaamic Monotheism and all that Islaam has ordained) and forbid Al-Munkar (polytheism, disbelief and all that Islaam has forbidden)}

Those who don’t refute the baatil, how would they command good?! How would they forbid evil?! How?! It is like the Jamaa’at at-Tableegh who say they command good but (in reality) they don’t, Tawheed is at the highest rank of good but they do not call the people to it, (as for) Salat (prayers) they do not command the people with the Salat of Muhammad (sallalaahu ‘alaihi wasallam). They claim to command good but (in reality) they do not command good and they do not forbid evil. We ask Allaah’s safety.

So what is the faraq (difference) between you and them if you do not fight bid’ah and misguidance and refute Ahlul Ahwa, what is the faraq between you and them? So if you see the people of misguidance then you are silent on them and in return this increases their masses, you are supporting and encouraging them by being silent on them when they make fasaad (corruption) on Earth! When you see thieves stealing from the houses, then you are silent on them! What is this? Is this commanding good and forbidding evil? So the du’aat (callers) of Ahlul Bid’ah (people of innovation) is worse than thieves, worse than the highway robbers. Ibn Abee Zaid and Ibn’Abdul Birr said: They are worse than the criminal highway robbers, it is waajib to warn from them continuously, and criticize and expose them in front of the people to stay out of them, up until the people leave them.


And because of this there exists many books of the Salaf refuting Ahlul Bid’ah and warning against them, warning against their gatherings, but during these times many from the Muslimoon has left of this ‘asl (foundation): refuting Ahlul Bid’ah and warning from them, and this caused the misguidance to prevail on this Ummah of Islaam, except that a few miskeen who have no power or might are saved from this.

'Eid Milad (The Prophet's Birthday)

Question:

What is the ruling upon celebrating the birthday of the Prophet (sal Allaahu alaiyhi wa sallam) in the month of Rabee’ ul Awwal, as a means of extolling him – sal Allaahu alaiyhi wa sallam?

Answer:

Extolling the Prophet and venerating him is only through: eemaan in everything with which he came from Allaah, and following his sharee’ah – in aqeedah (creed), and speech, and action, and manners – and leaving off innovating in the religion.

And celebrating the birthday of the Prophet (sal Allaahu alaiyhi wa sallam) is from innovating in the religion.

And with Allaah is the tawfeeq. And may peace and blessings be upon our Prophet, Muhammad and upon his family and Companions.

نصائح علماء السلفية لأهل السنة في الجزر المالديفية-.2.1

Nasyha of 'Ulama as-Salafiyyah to Ahlu-Sunnah of Maldives. (Part 2.1, the english translation)
Nasyha of al-Fadeelat as-Shaykh
Yahyaa bin Alee al-Hajoori (Hafidhahullaah):
النصيحة الشيخ يحيى بن علي الحجوري -حفظه الله
It was asked, 'What is your advice to the Ahlu Sunnah of Maldives?'
Allaamah Naasihul Ameen Shaykh Yahya bin Alee al-Hajoori replied:
My advice to them is to seek knowledge, as the prophet (sallalaahu 'alaihi wasallam) said:
من يرد الله به خيرا يفقهه في الدي
" If Allaah is pleased with someone, He gives him the fiqh (understanding) of the religion."
And also he (sallalaahu 'alaihi wasallam) said:
خيركم من تعلم القران و علمه
"The best of you are those who learn the Qur'aan and teach it"

(And Allaah said:)يَرْفَعِ اللَّهُ الَّذِينَ آمَنُوا مِنكُمْ وَالَّذِينَ أُوتُوا الْعِلْمَ دَرَجَاتٍ
"Allâh will exalt in degree those of you who believe, and those who have been granted knowledge. And Allâh is Well-Acquainted with what you do." (Al-Mujadilah 58:11)

And knowledge is virtuous for the slave and is a noor (light) for him too as Allaah has named it:
أَوَمَنْ كَانَ مَيْتًا فَأَحْيَيْنَاهُ وَجَعَلْنَا لَهُ نُورًا يَمْشِي بِهِ فِي النَّاسِ كَمَنْ مَثَلُهُ فِي الظُّلُمَاتِ لَيْسَ بِخَارِجٍ مِنْهَا
Is he who was dead (without Faith by ignorance and disbelief) and We gave him life (by knowledge and Faith) and set for him a light (of Belief) whereby he can walk amongst men, like him who is in the darkness (of disbelief, polytheism and hypocrisy) from which he can never come out? (Al-An'am 6:122)

And Allaah said:
وَكَذَلِكَ أَوْحَيْنَا إِلَيْكَ رُوحاً مِّنْ أَمْرِنَا مَا كُنتَ تَدْرِى مَا الْكِتَـبُ وَلاَ الاِْيمَـنُ وَلَـكِنْ جَعَلْنَـهُ نُوراً نَّهْدِى بِهِ مَن نَّشَآءُ مِن عِبَادِناً وَإِنَّكَ لَتَهْدِى إِلَى صِرَط مُّسْتَقِيم
"And thus We have sent to you (O Muhammad) Ruhan (an Inspiration, and a Mercy) of Our Command. You knew not what is the Book, nor what is Faith? But We have made it (this Qur'ân) a light wherewith We guide whosoever of Our slaves We will. And verily, you (O Muhammad) are indeed guiding (mankind) to the Straight Path (i.e. Allâh's religion of Islâmic Monotheism). (Ash-Shura 42: 52)"

Knowledge is the Book of Allaah and the Sunnah of the Messenger of guidance (sallalaahu 'alaihi wasallam). Allaah Azza wajal said:
هُوَ الَّذِي أَرْسَلَ رَسُولَهُ بِالْهُدَى وَدِينِ الْحَقِّ لِيُظْهِرَهُ عَلَى الدِّينِ كُلِّهِ وَكَفَى بِاللَّهِ شَهِيداً
He it is Who has sent His Messenger (Muhammad) with guidance and the religion of truth (Islâm), that He may make it (Islâm) superior over all religions. And All-Sufficient is Allâh as a Witness. (Al-Fath 48:28)

And the guidance is the beneficial knowledge, and the religion of truth, and that is the 'amal as-saalih. This is what I advice you with, obedience to Allaah subuhaanahu wata'aala and avoidance of bid'ah, shirk and superstitions...And implement the Sunnah as the prophet sallalaahu 'alaihi wasallam said:
عليكم بسنتي وسنة الخلفاء الراشدين المهديين ، عضّوا عليها بالنواجذ ، وإياكم ومحدثات الأمو
'Upon you is to follow my Sunnah and Sunnah of the rightly guided caliphs after me, and hold on to it with your molar teeth, and Beware of newly invented matters"

And Allaah 'Azza waJal said:
لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ لِّمَن كَانَ يَرْجُو اللَّهَ وَالْيَوْمَ الْآخِرَ
Indeed in the Messenger of Allâh (Muhammad) you have a good example to follow for him who hopes in (the Meeting with) Allâh and the Last Day and remembers Allâh much. (Al-Ahzab 33:21)
And also said:
وَمَا كَانَ لِمُؤْمِنٍ وَلَا مُؤْمِنَةٍ إِذَا قَضَى اللَّهُ وَرَسُولُهُ أَمْراً أَن يَكُونَ لَهُمُ الْخِيَرَةُ مِنْ أَمْرِهِمْ وَمَن يَعْصِ اللَّهَ وَرَسُولَهُ فَقَدْ ضَلَّ ضَلَالاً مُّبِيناً
It is not for a believer, man or woman, when Allâh and His Messenger have decreed a matter that they should have any option in their decision. And whoever disobeys Allâh and His Messenger, he has indeed strayed in a plain error. (Al-Ahzab 33:36)

And Allaah subuhaanahu wata'aala said:
فَلاَ وَرَبِّكَ لاَ يُؤْمِنُونَ حَتَّىَ يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لاَ يَجِدُواْ فِي أَنفُسِهِمْ حَرَجاً مِّمَّا قَضَيْتَ وَيُسَلِّمُواْ تَسْلِيماً
But no, by your Lord, they can have no Faith, until they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission. (An-Nisa 4:65)
And He,Azza waJal also said:
لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ
Indeed in the Messenger of Allâh (Muhammad) you have a good example to follow
